Local law firm obtains 4th highest jury verdict in NC

North Carolina Lawyers Weekly recently reported that Dunn law firm Brent Adams & Associates obtained the fourth highest personal injury jury verdict in North Carolina during 2020.

North Carolina Lawyers Weekly, a newspaper distributed primarily to the legal profession, issues a report each year covering the 50 highest verdicts and settlements obtained by law firms throughout the state of North Carolina during the previous year.

The case, Cain v. Wal-Mart Stores Inc., was tried in Cumberland County in January 2020. The jury awarded the plaintiff, John Cain, $2 million plus interest at 8% from the date the lawsuit was filed. Including the interest reward, Walmart had to pay Cain over $2.6 million.

Cain was injured while shopping at a Fayetteville Walmart when he bent down to pick up a 50-pound bag of Ol’ Roy Dog Food and seven 50-pound bags of dog food fell on Cain’s neck and back, knocking him to the ground.

Cain drove himself home after the injury but was later seen at the VA Hospital where he was treated for neck and back injuries over a period of years.

A jury determined that Walmart was negligent for stacking its dog food too high and that the 50-pound bags of dog food constituted a danger to the shopping public.

Cain’s doctors did not recommend surgery for him, but, instead, told him that his injuries to his neck and back were something that he has to live with and that this condition was permanent. Cain reports that he has had significant pain and discomfort since the dog food fell on him. His doctor testified that he would likely experience pain and discomfort into the future.

Cain, who is an Army veteran, was treated at the VA Hospital for his injuries. The bills for these injuries were not introduced at trial and were not a part of the lawsuit.

Brent Adams & Associates has been featured in multiple highest top jury verdict reports over the years.

In Lawyers Weekly’s 2018 report of the highest verdicts and settlements reports obtained in North Carolina for that year, Brent Adams & Associates had the 22nd highest personal injury settlement in North Carolina. This case involved a $2 million settlement for a student who was shot at a Cumberland County school.

North Carolina Lawyers Weekly reported in its coverage of the highest verdicts in North Carolina during 2015 that Brent Adams & Associates obtained the fourth highest personal injury jury verdict in North Carolina that year. The verdict was in the amount of $3.4 million for its client whose son was killed in a Johnston County bar fight.
