NORTH CAROLINA HARNETT COUNTY NOTICE OF SALE OF LAND FILE NO. 19 SP 266 Under and by virtue of the powers of sale contained in that Deed of Trust executed by Brandon Turlington to Luther D. Starling, Jr., Trustee for Crop Production Services, Inc., Beneficiary, dated March 23, 2015 and recorded April 13, 2015 at Book 3297, page 341, Harnett County Registry, which instrument describe a tract of land located in HARNETT COUNTY, NORTH CAROLINA, default having been made in the payment of the indebtedness thereby secured and failure to carry out or perform the stipulations and agreements therein contained, and Nutrien Ag Solutions, Inc. f/k/a Crop Production Services, Inc., the present holder of the indebtedness thereby secured having demanded a foreclosure thereof for the purpose of satisfying said indebtedness, and the Clerk of Superior Court of Harnett County, granting permission for the foreclosure on July 17, 2019. Said Luther D. Starling, Jr., Trustee, will offer for sale at public auction to the highest bidder for cash at the Harnett County Courthouse door in Lillington, North Carolina, at 10:00 A.M. on the 28th day of August, 2019, as improved, conveyed in said Deed of Trust, the same lying and being in Harnett COUNTY, NORTH CAROLINA, and being more particularly described as follows: Beginning at a stake on the run of Thornton’s Creek, the southwest at corner of Lot No. 3 of said subdivision, and runs due East 26.58 chains to a stake in Sim Williams line; then with Sim Williams line South 2 degrees West 9.60 chains to a stake; the northeast corner of Lot No. 1; then with the line of Lot No. 1 due west 27.70 chains to the run of Thornton’s Creek; then up the various courses of the run of said creek to the beginning and contains 28 acres, more or less. There is excepted from the aforesaid lands the following described Tract: Being all that certain tract or parcel of land containing 5.134 acres, more or less, being situate on the southern side of secondary road no. 2004 and bounded now or formerly on the North by said road, on the East by the lands of W.P. Moore, Sr., on the South and West by the Lands of Graham Y. Turlington and more particularly described as follows: Beginning at an iron pipe in the southern margin of the right of way of Secondary Road No. 2004, a corner with Thelands of W.P. Moore, Sr. and runs thence of the line of W. P. Moore, Sr., South 2 degrees West 316.4 feet to an iron pipe, a corner with Graham Y. Turlington in the said Moore line (the corner with said Turlington being a new corner Established this day); thence a new line with Graham Y. Turlington South 86 degrees 44 minutes 5 seconds West 698.15 feet to an iron pipe, a new corner with Graham Y. Turlington; thence a new line with Graham Y. Turlington North 1 degree 47 minutes East 323.95 feet to an iron pipe, a new corner with Graham Y. Turlington in the southern margin of the right of way of Secondary Road No. 2004 North 87 degrees 21 minutes 37 seconds East 698.72 feet to the point of beginning. The aforesaid tract of land is part of those lands conveyed from W.G. Williams to Hester Williams by Deed dated November 23, 1935, and recorded in Book 256, Page 256, Harnett County Registry. In the Substitute Trustee’s sole discretion, the sale may be delayed for up to one (1) hour as provided in Section 45-21.23 of the North Carolina General Statutes. The record owner(s) of the real property not more than ten days prior to the date hereof is Brandon Turlington. The real property hereinabove described is being offered for sale AS IS, WHERE IS and will be sold subject to all superior liens and judgments, unpaid taxes, special assessments, conditions, easements and restrictions of record. The sale will be held open for (10) days for upset bids as by law allowed. This sale will be further subject to the right, if any, of the United States of America to redeem the above-described property for a period of 120 days following the date when the final upset bid period has run. To the extent this sale involves residential property with less than fifteen (15) rental units, you are hereby notified of the following: a. An order for possession of the property may be issued pursuant to Section 45-21.29 of the North Carolina General Statutes in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold; and b. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement upon 10 days written notice to the landlord. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination. If the Trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition and the reinstatement of the loan without the knowledge of the Trustee. If the validity of the sale is challenged by any party, the Trustee in his sole discretion, if he believes the challenge to have merit, may declare the sale to be void and return the deposit.
